TERMS AND CONDITIONS OF SALE

Welcome to Fancy-dress.com. The use of the website and/or the placing of an order is subject to your acceptance of these Terms and Conditions. However, any statutory rights that you may have as a consumer remain unaffected.

1. DEFINITIONS

In these Terms and Conditions the following expressions are to be understood as defined below:

• 'the Company'/'we' shall mean Fancy Dress Limited (Company Registration Number: 6683105) T/A fancy-dress.com, registered office address 408 Houldsworth Mill, Waterhouse Way, Reddish, Stockport, Cheshire SK5, 6DD. (Shop located at 163 Great Ducie Street, Manchester, M3 1FF)
• 'the Buyer' shall mean the person, firm, company or organisation, the user of this website, with whom the contract to sell the goods is made by the Company;
• 'the Products' means the articles, things or products or any of them described that are ordered by internet from the Company's website.

2. CONDITIONS

These conditions shall form the basis of the contract between the Company and the buyer for the sale and purchase of products but shall not, in their application, affect the statutory rights of the Buyer in any way.

3. ACCEPTANCE OF ORDERS

We undertake to acknowledge receipt of the order without any due delay. No order shall be binding on the Company unless and until it has been acknowledged and accepted electronically or otherwise in writing, by the Company. Orders are accepted on the strict understanding that all liabilities of the Company to the Buyer shall be discharged on receipt by the Buyer of a satisfactory product made to specification. Orders are accepted subject to the following terms and conditions which are deemed to be incorporated in all contracts of the Company to sell goods.

4. PRIVACY

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service.

The type of information we will collect about you includes:

• Your Name
• Address
• Telephone Number
• E-mail address
• Credit/debit card details

The information we hold will be accurate and up to date. You can check the information that we hold about you by e-mailing us. If you find any inaccuracies we will delete or correct them promptly.

The personal information which we hold will be held securely in accordance with our internal security policy, with English law.

If we intend to transfer your information outside the EEA (European Economic Area) we will obtain your consent first.

We may use technology to track the general patterns of behaviour of visitors to our site. If you have any questions or comments about privacy, please email us.

5. PRICES

Prices, in GB £'s Sterling, for each product in the Online Catalogue are correct at time of entering the information into the system. The total cost of individual terms ordered from the catalogue will be made up as follows:

For EU (European Union) customers - the price of the product is as shown in the online catalogue plus UK VAT (valued added tax) of 17.5% plus a delivery charge that varies with the country of destination (see the chart for details).

For customers in countries outside the EU - the price will be the price of the product ordered plus the delivery charge as shown for the customer's home country. Any local import, customs, sales, VAT or similar taxes are not included in the purchase price and are the sole responsibility of the customer.

6. PAYMENT

You may order and pay for your order in any of the following ways:

• online by using most major credit and debit cards: Mastercard, Visa, Switch, Solo, Delta, American Express, Barclaycard;
• by telephone, post, e-mail or fax, using a crossed cheque or banker's draft in GBP (£'s) made payable to Costumes Direct, or by postal or money order.
  

7. TIME OF DELIVERY

Any delivery time referred to in any online quotation or acceptance by the Company shall be deemed to commence from the date of receipt by the Company of an official order electronically signed by the Buyer and accepted in writing or by electronic means by the Company.

The Company will deliver the goods in the UK within 7 days of order. For addresses outside the UK it may take a little longer depending on distances to destination.

If delivery is delayed by strikes, fires, accidents, defective materials or other causes beyond the reasonable control of the Company, a reasonable extension of time for delivery shall be granted to the Company by the Buyer.

8. SHORTAGES AND DAMAGE ON RECEIPT OF GOODS

The Buyer shall not any claim for short delivery and/or for damage to goods during transit on the postal delivery note and shall confirm the claim in writing to the head office of the Company within seven (7) days from the date of delivery. If short delivery does take place, the Buyer can either reject all the goods and obtain a refund or pay a proportionate price for the goods short-delivered.

9. COMPANY GUARANTEE

The Buyer shall carry out a thorough inspection of the goods within 7 days after their delivery and shall give immediate written notification to the Company of any defects, faults, short or wrong deliveries that a reasonable examination would reveal.

Subject to compliance with the above requirements which shall be a condition precedent to the Company's liability, the Company shall, at the Buyer's discretion, replace, or give a refund on, any products which are not satisfactory due to faulty materials or workmanship. The Company shall, however, not be liable for any consequential damage or loss unless such damage was within the prior contemplation of both parties at the time of entering into the contract.

10. CANCELLATION (For buyers within Europe)

 

The buyer has the right to cancel a purchase within a limited period. To cancel this contract please send the items comprising the cancelled purchase to us within 7 working days of the date that the item(s) was/were delivered to you.

 

Return within 7 days is, however, not a condition for us to honour our commitment to make a refund to you within 30 days. Should the goods not be returned to us, however, we reserve the right to make a charge for the costs incurred in collecting.

 

(For buyers outside Europe)

The Buyer has the right to cancel a purchase within a limited period. Please inform us of your cancellation within 7 working days of the date that the item(s) was/were delivered to you and return the goods to us within 30 days. We shall refund you once we have received the goods and within 30days of receipt of the item(s).

 

(Return post)

 

When sending goods back to us, please write "RETURNED GOODS" on the parcel and include your contact details, order number (if applicable) and reason for returning the item on the parcel. This will make it quicker for us to make a refund. Thank you.

11. DELAYED DELIVERY

Whilst every endeavour will be made to adhere to quoted delivery times, the Company cannot accept liability for any losses incurred by the Buyer that result from delay unless within the prior, reasonable contemplation of both parties when the contract was entered into.

Delays shall not entitle the Buyer to cancel the order not to claim for loss of trade, or profits or damages against the Company. In case of delays caused by circumstances beyond its control, including force majeure happenings such as fires, floods, earthquakes, wars, strikes, riots, civil commotions, epidemics and unpredictable natural events beyond the control of the Company or acts of governmental authorities, including supra-national governmental bodies, the Company retains the right to either suspend deliveries or to cancel the contract without liability.

13. COMPLAINTS

We endeavour to respond to all complaints within five (5) working days.
